The purpose of these general conditions is to define the rights and obligations of the parties in the context of the online sale of goods offered by THE SELLER to the consumer. They concern sales made by Mademoiselle Candle Cup, on its website:

All prices mentioned on the Mademoiselle Candle Cup website are in Euros (€), including VAT and excluding delivery costs. The price indicated in the order confirmation is the final price of the sale.

Any customs duties to be paid will be at the buyer's expense.

ARTICLE 4 Validation and processing of the order :

The automatic recording systems are considered as proof of the order, which becomes final after acceptance of the transaction by the SSL secure online payment services for payment by bank card or Paypal; or after cashing of the payment cheque by our bank for any payment by bank cheque.

The information given by the buyer when placing the order is binding on the buyer: in the event of an error in the recipient's details, the seller cannot be held responsible for the impossibility of delivering the product.

The average processing time for orders is 48 hours, unless otherwise stated on the homepage during the administrative holiday period.

Mademoiselle Candle Cup reserves the right to cancel any order from a customer with whom there is a dispute over payment of a previous order.

Mademoiselle Candle Cup uses the shipping services offered by the company BOXTAL (including several carriers such as Chronopost, Colissimo, Mondial Relay, Happy poste ...)

The average delivery time depends on each carrier:

  • 2 to 3 working days in metropolitan France by colissimo
  • 5 to 6 working days in metropolitan France in a relay point
  • 4 to 15 working days depending on the destination for Europe and the rest of the world.

La Pelote Parisienne is not responsible for the delays of the transporters of goods.

In accordance with the Chatel law, your order will be dispatched within a maximum of 30 working days from receipt of payment.

The company Mademoiselle Candle Cup undertakes to honour orders received on the website only within the limits of available stocks of products. In case of unavailability of the product after placing your order, Mademoiselle Candle Cup undertakes to inform the user and to indicate the waiting period for receipt of this product .

The user's account will be debited with the total amount of the order when the order is placed. In the event of products being sold out or unavailable, the user's account will be credited with the amount of the products not sent if he/she paid by card or he/she will receive a cheque if he/she paid by cheque.

The products remain the sole property of Mademoiselle Candle Cup until full payment is received by Mademoiselle Candle Cup.

Mademoiselle Candle Cup will ship the order to the name and address registered in the "delivery address" field. It is the customer's responsibility to verify the accuracy of the address.

The seller reserves the right to split deliveries.

ARTICLE 6 Payment.

The price invoiced to the customer is the price indicated on the order confirmation. The price of the order is payable in cash at the time of the order.

Secure payment is made by Visa and Master Card or via Paypal.

It is possible to pay by cheque made out to Mademoiselle Candle Cup and sent to us by post.

In the case of payment by cheque, the goods will be sent as soon as the bank confirms that the cheque has been cashed.

Your credit card number is therefore directed to the bank's servers, your payment is made directly to the bank in a secure environment without going through the shop's server, a guarantee that is all the more important as your numbers are known only to our banking partner.

The majority of the products offered on the Mademoiselle Candle Cup website are available in our warehouse.

In the event of unavailability of product after placing the order, Mademoiselle Candle Cup will inform the customer by email or telephone as soon as possible.

The customer may then request the cancellation, refund or exchange of the order from Mademoiselle Candle Cup.

ARTICLE 8. Warranty on products

8.1. Contractual guarantee

The photos, descriptions and prices of the products are not contractual.

The photographs illustrating the products are not part of the contract.

If there are any errors, Mademoiselle Candle Cup cannot be held responsible.

8.2 Legal guarantees

In any case, the customer benefits from the legal guarantee of eviction and hidden defects on the condition that the buyer proves the hidden defect.

The customer may not avail himself of the conventional guarantee if the defect results from :

  • normal wear and tear of the article and/or its parts and/or accessories,
  • abnormal use and/or improper handling
  • lack of maintenance
  • force majeure

ARTICLE 9. Guarantee concerning the Site

Mademoiselle Candle Cup does not guarantee:

  • that the functions contained in the mademoisellecandlecup. com e-commerce site and any content or other material contained therein will at all times be available, uninterrupted or error-free,
  • that any defects or errors will be corrected immediately,
  • that the site or its server will at all times be free of viruses or other components that may cause damage.

If you encounter any problems, please contact us as soon as possible so that we can resolve them.

ARTICLE 10. Liability

10.1 The photos on the website are for illustrative purposes only. We invite you to refer to the description of each article to know the precise characteristics. In case of doubt or if you need additional information, do not hesitate to contact us.

These other sites are not under the control of Mademoiselle Candle Cup and you acknowledge that Mademoiselle Candle Cup is not responsible for the accuracy, respect for intellectual property rights, legality, decency or any other aspect of the content of these sites.

ARTICLE 11. Right of withdrawal.

In accordance with current legislation, the withdrawal period is 14 days from the day after receipt of the goods.

The request for withdrawal must be made in writing and the goods returned in their original, unused packaging. The customer is responsible for the costs of returning the goods.

We undertake to exchange the goods or to refund you, provided that the goods are neither used nor damaged and that they are returned to us in their original packaging, together with the order, to the address of the registered office (mentioned above).

ARTICLE 12: Force majeure

The performance of the seller's obligations hereunder shall be suspended in the event of the occurrence of an act of God or force majeure. The seller shall notify the customer of the occurrence of such an event as soon as possible.

ARTICLE 13: Protection of personal data

In accordance with the French Data Protection Act of 6 January 1978, you have the right to question, access, modify, oppose and rectify your personal data. By adhering to these general conditions of sale, you agree that we may collect and use this data for the purposes of this contract.
